Notary

Real estate law

According to German law, legal transactions that concern a property are subject to notarial certification.

As a notary, I advise you on the question of drafting land purchase agreements, be it a purchase between private individuals or a purchase from a developer.

Advise on donations and other transfer processes, for example in the context of anticipated successions, are also part of the repertoire I can provide.

In most cases, I may also advise on appropriate financing and security through a land charge.

The notary is also responsible for ordering or deleting easements.

Commercial law

I advise on the drafting of the articles of association of partnerships and corporations (AG, GmbH, UG, Limited under English law, OHG, KG, mixed forms of these companies) as well as their establishment and entry in the commercial register.

Upon request, I will also be happy to advise you on other questions, such as the drafting of management contracts, status determination procedures, etc.

The notary also accompanies the conversion of existing companies.

Family law

In the area of family law, the notary is responsible for agreements on property law such as the drafting of marriage contracts.

Even in the case of a separation, disputes can often be settled amicably - among other things because of post-marital maintenance, compensation under property law (e.g. profit claims), as well as pension compensation and household effects - by drafting a balanced divorce-consequences agreement. You can also record child support claims in a notarized deed.

The great advantage of such a deed is that the notary can create a title that can be enforced without going through a court.

Inheritance law

In the area of inheritance law, the notary offers comprehensive advice on the legal succession as well as on the possibilities of deviating the succession through will, inheritance contract and / or donation between living persons.

This also includes regulations on the waiver of inheritance and / or the waiver of compulsory portions, contracts on inheritance as a whole, etc.

After the inheritance - if necessary - the inheritance procedure is initiated submitting an application through notarial certification.

Creating a title

It is often unknown that the notary can also create a title that can be enforced by way of enforcement, which equates to a judgment, enforcement order or a court settlement, but is in some cases significantly cheaper.

The prerequisite for this, however, is that both parties involved are in agreement. In contrast to the judicial process, none of the parties involved is forced to participate.

Notarial deeds of these declarations of submission to immediate enforcement are often appropriate in the area of acknowledgment of guilt.

Lawyer

Family law

While the notary is the neutral point of contact in the area of family law, the lawyer, on the other hand, is purely partial to one of the parties. The notary arbitrates, the lawyer fights for you, right after the separation.

Immediately after the separation there are some existential questions like: Who owes whom, maintenance pensions, who stays in the usual place of residence, etc. that require our services.

The divorce itself must in any case be made through a court judgment. We also represent you in court both during the divorce process and the subsequent follow-up matters such as maintenance claims, child support, profit compensation, pension compensation as well as questions about joint and several debt settlement in the case of joint debts of the spouses.

Traffic law

I advise clients in traffic accidents with regard to the assertion of claims for damages against the opponent and his liability insurance. Many clients do not know what claims and in what amount they are entitled to. The insurance companies have no interest in drawing your attention to the amount of compensation you are entitled to. I will help you figure out your claims and enforce them.

In the event of a traffic accident, the question of who is responsible for it also arises in the criminal area. I advise and represent you as a defense attorney in the related criminal and fine proceedings. This is particularly important because these procedures also have an indicative effect in the civil law area of claims settlement.

Bankruptcy law

In the area of insolvency law, I regularly advise debtors. The focus is on avoiding filing for bankruptcy. However, if this is not possible or does not seem appropriate, filing for bankruptcy may be the way to go.

However, bankruptcy alone does not help the debtor. It is rather important to show the debtor the so-called residual debt discharge because only exemption from residual debt is the way to final debt relief.

Many are not aware that the insolvency procedure and the residual debt discharge procedure are two different procedures.

Employment Law

I represent both employers and employees in and out of court.

On the employer's side, I advise with the formulation of dismissals, warnings, work agreements, employment and termination agreements, temporary employment contracts, etc.

On the employee's side, I take on the representation of interests in the context of dismissal protection lawsuits, lawsuits for the removal of warnings from the personnel file, lawsuits for payment of wages and salaries, etc.


Inheritance law

In addition to comprehensive advice on legal succession, I also advise on questions of how the succession is structured through wills, inheritance contracts and / or donations between living people.

The other aspects of succession, such as the creation and assertion of claims to a compulsory portion of passed heirs, are an important part of the advisory practice.

Immigration Law

Working in the area of inheritance and family law almost inevitably results in points of contact with international law and immigration law.

Here, questions of marrying foreign citizens and the possibility of family reunification with foreign partners and underage children are the subject of the advisory practice.
